CHILTON, WI (WTAQ) – A jury found Codi Miller guilty Friday for the drunken driving crash which killed his motorcycle passenger and injured a boy on his bicycle.
Miller is now 23 years old. He was convicted on seven counts in the case, including homicide by intoxicated use of a vehicle and injury by intoxicated use of a vehicle.
The crash happened Augusut 19th, 2018, at the intersection of Highway KK and State Park Road in Harrison.
Kim Anderson, 53, a passenger on Miller’s motorcycle, was killed. Henry Schinke, 13, who was riding his bike, was seriously injured.
While traveling east along Hwy. KK, Miller told investigators a vehicle in front of him moved into the westbound lane. When that vehicle moved back into its lane, Miller told officers he saw Schinke in the intersection, headed south. Miller said by the time he saw the boy, it was too late. He swerved to try to miss the boy, but clipped the boy’s rear tire. In the process, the motorcycle tipped over, throwing Miller and Anderson off.
A blood test showed Miller’s blood alcohol concentration at .210. Because of three previous drunken driving convictions, Miller had a .02 limit for driving.
Sentencing for Miller is set for May 27th.
