GREEN BAY, WI (WTAQ) – The name of the man killed in a hit and run in Ashwaubenon on Saturday has been released, and the man who police say hit him appeared in court on Monday.
Ashwaubenon Police say 38-year-old Chad Scott was drunk when driving the vehicle that hit and killed Derrick Lyshon Murphy, a 43-year-old Green Bay man at Ashland Ave and Cormier Rd at around midnight.
Scott has been charged with homicide by intoxicated use of a vehicle, homicide by use of a vehicle while using a controlled substance, and hit and run involving death.
Scott says he smoked marijuana about 10 p.m. Friday night, before picking up his son at his job.
In Wisconsin, there is no threshold level for marijuana as there is for alcohol; any presence of the illegal drug can result in charges. In most cases, there is no requirement for prosecutors to show impairment caused by the drug.
If convicted of all three charges, he faces up to 75 years in prison.
