GREEN BAY, WI (WTAQ) – An NWTC student that is suing the college has asked a judge to rule in her favor and end the case.
Polly Olsen sued after being stopped by campus officials last valentines day from handing out religious-themed cards.
She claims that the suppression was “based, in part, on the religious content of the cards,” according to the 23-page lawsuit.
The college said at the time the suit was filed that Olsen was violating the school’s public assembly policy, which sets a designated space for distribution of literature, picketing or displaying protest signs.
While the report states that Olsen was not in that area.
The college said at the time that it was reviewing its policy.
No trial date in the case has been set and on Tuesday Olsen’s attorney filed a 30-page brief that requested the court declare NWTC Public Assembly Policy unconstitutional.
No ruling has been made on a previous motion by NWTC, which asked the court to dismiss the case in its favor.
The judge told the two sides to consider mediation in November, but there is no record in the case file to indicate that has been scheduled.
