GREEN BAY, WI (WTAQ) – An appeal has been filed by one of the men convicted of killing Tom Monfils.
Keith Kutska is appealing a recent decision denying him a new trial. Retired Outagamie County Judge James Bayorgeon made the ruling in January.
This week, Kutska’s attorneys filed an appeal, saying, “Because a host of constitutional violations precluded the jury from learning what actually happened to Tom Monfils, Kutska’s conviction should be vacated in the interests of justice.”
The appeals court usually decides cases based on written arguments. The state has not responded to the appeal.
Kutska, along with Michael Hirn, Michael Johnson, Michael Piaskowski, Dale Basten and Rey Moore, were convicted of killing Monfils in 1992 at a Green Bay paper mill.
All are serving life prison terms except for Piaskowski, whose conviction was overturned by a federal judge.
