SHEBOYGAN COUNTY, WI (WTAQ) – Steven Avery’s motions for a new trial have been denied.
Sheboygan County Judge Angela Sutkiewicz has issued a six-page ruling that you can read here, courtesy of WLUK.
“In light of the discussion of the evidence above and the conclusion with relation to the ability to appeal and venue for an appeal, the defendant has failed to establish any grounds that would trigger the right to a new trial in the interests of justice. As such, no further consideration will be given to this issue,” Sutkiewicz writes.
In the ruling, Sutkiewicz dismisses several claims, including arguments involving DNA and scientific testing.
“Given the totality of evidence submitted at trial and the ambiguous conclusions as stated in the experts’ reports, it cannot be said that a reasonable probability exists that a different result would be reached at a new trial based on these reports. As such, the defendant has not met his burden in order to obtain a new trial.”
Avery’s attorney Kathleen Zellner was previously granted a request to dismiss appeals before a state court so she could instead focus her attention on post-conviction motions at the county level.
Avery is serving a life sentence for the 2005 murder of Teresa Halbach.
