UNDATED (WSAU) “Making A Murderer” defendant Steven Avery has been turned down for a new trial again.
A Sheboygan County judge denied Avery’s request from October to reconsider her order that denied a new trial in the 2005 murder of Teresa Halbach. Defense attorney Kathleen Zellner tweeted shortly after the ruling yesterday, however, that the appellate court has had jurisdiction in the case. She filed a Notice of Appeal on November 17th and it was acknowledged on Monday.
Avery and nephew Brendan Dassey were found guilty of the murder in 2007. The Netflix series “Making A Murderer” has put a spotlight on their case.
Avery and Dassey were both sentenced to life prison terms. Avery says he was framed, and his lawyers say there is new evidence and testimony that would exonerate him.
Dassey’s confession to police has been thrown out, overturning his conviction. But Dassey remains in prison while the state appeals that decision.
