UNDATED (WTAQ) – The Wisconsin Department of Justice believes that Steven Avery should not be released from prison on bond.
That’s after Avery filed an appeal last week claiming a search warrant in Teresa Halbach’s murder case was improperly issued. Avery sought to be released on bond in the January 11 filing, arguing that any evidence found as a result of that search was illegal.
The Netflix series “Making a Murderer” has led to massive nationwide attention to the trials of Avery and his nephew Brendan Dassey back in 2007. Both were convicted in the murder of Halbach in 2005.
Assistant state attorney general Thomas Fallon wrote in the state’s response that the seriousness of the crime for which Avery was convicted and past unsuccessful appeals by Avery play a role in their argument.
“There is a substantial risk Avery will not appear to answer the judgment following the conclusion of post-conviction proceedings,” Fallon writes. “He has nothing left to lose.”
