UNDATED (WSAU) New court documents are being filed in the appeal of a ruling overturning the conviction of Brendan Dassey, the nephew of “Making a Murderer” subject Steven Avery. A judge ordered Dassey to be freed from prison in August based on the manner in which his confession to helping Avery rape and kill photographer Teresa Halbach was obtained. Prosecutors argued in a brief filed in federal court on Wednesday that Dassey voluntarily and accurately confessed to the crime after Halbach was found on the Avery family property in Manitowoc County. The state’s legal brief says Dassey was aware of the crime he was confessing to.
Dassey remains in prison while appeals are pending.
The appeals are pending before the 7th Circuit Court of Appeals in Chicago. The court could take several months to rule.
Prosecutors have already said they intend to re-try Dassey should he ultimately be releasd.
Avery remains behind bars, although his new attorney is fighting to re-test DNA evidence that prosecutors say link him to the Halbach murder.
