MADISON, WI (WTAQ) – The Wisconsin Supreme Court heard arguments regarding whether a Sister Bay condo association will be allowed to sue the village about noise from the municipal band shell on Monday.
The Yacht Club at Sister Bay Condominium Association is claiming the noise constitutes a public nuisance and has sued the village.
The high court is examining if the lawsuit was filed in a timely manner and should be allowed to continue, not the merits of the noise complaint.
Concert performances began in August of 2014 after the pavilion was built in 2013. The condo association filed suit to stop the performances in March of 2016. The court ruled that the condo association didn’t provide notice within the 120-day window from when the nuisance began, which the condo association appealed claiming that they filed within 120-days of the most recent concert.
A ruling from the Wisconsin Supreme Court will be released in a few months.
