MADISON, WI (WSAU) A Wisconsin tribe is trying to save their lawsuit over a Shawano County casino. The Stockbridge-Munsee Community sued the Ho-Chunk Nation and the state earlier this year over the expansion of gaming site in Wittenberg. The Stockbridge-Munsee band argues that the Wittenberg site was supposed to be a slots-only facility, and has now been expanded to include electronic table games, a restaurant, and a hotel.
The Stockbridge-Munsee operate the North Star Casino, about 15-miles away from the Ho-Chunk expansion. They have also threatened not to make payments to the state under the Indian gaming compact.
A judge dropped the Ho-Chunk from the lawsuit last month, ruling that some electronic table games were already in-use at Wittenberg for years and that the statute of limitations had run out to file a challenge.
Stockbridge-Munsee filed briefs this week in an effort to keep the state from being dismissed from the suit.
