MADISON, WI (WTAQ) – A Milwaukee federal judge is refusing to stay his order allowing voters in Wisconsin to cast a ballot without photo identification while the state Department of Justice appeals.
Earlier this month, U.S. District Judge Lynn Adelman issued a preliminary injunction allowing people unable to get IDs to vote in the November 8 general election if they sign an affidavit explaining why they couldn’t obtain the identification.
On Friday, the AP reports that Adelman refused to grant the stay by saying the injunction doesn’t block anyone from challenging a voter’s identity and some safety net must exist to protect the rights of voters who lack photo ID.
Officials with the Wisconsin DOJ have filed notice that they’ll appeal Adelman’s ruling with the 7th U.S. Circuit Court of Appeals and requested he stay the injunction until the appeal is resolved.
