GREEN BAY, WI (WTAQ) – A Green Bay man could spend the rest of his life in prison should he be convicted of sexually abusing his stepdaughter.
54-year-old Tito Sayas-Cabanas is charged with repeated sexual assault of the same child, first-degree sexual assault of a child without great bodily harm and incest with child by stepparent.
According to the criminal complaint, the now-18-year-old girl told police that the sexual assaulting first began when she was 11.
The alleged victim says Tito would ask her to come to his bedroom before she left for school and lay next to him. It began simply by Tito hugging her, but then became him asking the girl, “Lay on top of me to see how much I weighed.”
It was then that Tito, per the complaint, “Began to feel her breasts under her shirt and began to put his hand down her pants and put his finger inside of her vagina.” The girl admitted at the time she didn’t know what was going on, but that whatever it was made her uncomfortable.
The girl then says that Tito left for Mexico for about 11 months, but upon his return the abuse got worse.
The complaint states that, “She could feel Tito’s erect penis against her vagina, but that he would never take off his clothes. She said it felt like he was trying to have intercourse with her through the clothing.”
The girl added that this made her feel disgusting and the last time it happened was in September of 2015. Every time that Tito was finished assaulting her, he would, “Make her shower and take her out to eat.”
The complaint states that there’s no indication that Tito ever, “Ejaculated while on top of her and that she never saw his penis.”
The mother of the victim was first informed about the sexual abuse and touching when the girl was about 15. The girl told her mom to forgive Tito, because she, “Did not want her youngest brother to grow up without a father. Her mom told Tito to leave the house, but that he began to cry and asked for forgiveness so she allowed him to stay.”
Tito told his wife that he would never touch the girl again. After a few months, however, the touching and assault resumed. Once more, the victim didn’t want to tell her mom because her brother would be without a father.
Then on November 16, 2015, the mother told her daughter that she wanted to leave Tito. That’s when the victim admitted that the touching had started up again. Her mom began to cry and asked why she never told her.
“Her mom called their pastor who came to their house and took them to a hotel for the night,” per the complaint. “The girl said she felt more comfortable staying with the pastor and the pastor’s wife at their house.”
But while at the pastor’s house, Tito showed up. He claimed he was, “Suicidal and was asking the pastor’s wife for mercy. The pastor’s wife was asking Tito what he did, but Tito wouldn’t say, but just kept telling her that he was going to go to jail and that he was afraid of hell.”
Sayas-Cabanas is due back in Brown County Circuit Court on Friday, February 12 and is currently jailed on a $100,000 bond.
