WEST BEND, WI (WTAQ) – A mother from West Bend has filed a wrongful death suit against a homeowner who shot her son, after he ran into the man’s porch to hide from police.
Lauri Morrison is suing Adam Kind and his insurance company.
Authorities said 20-year-old Bo Morrison was fleeing from an underage drinking party in March of 2012 after the police got there. He was hiding in Kind’s dark porch when the homeowner found him and shot him once.
The Washington County district attorney said the shooting was justified. It was the first such ruling under Wisconsin’s “Castle Doctrine Law,” which assumes that deadly force is justified against unlawful intruders.
The incident spurred protests which called for the repeal of the Castle Doctrine law — which never happened.
Now, a lawyer who represents Morrison’s family calls the death “a tragedy that could have been avoided.”
Kind’s attorney said his client feels terrible about the incident — and he regrets that his actions are being scrutinized again in the courts.
