Undated (KELO-AM) The historic lawsuit against South Dakota's gay marriage ban was filed Thursday in U-S District Court in Sioux Falls.
Attorney Josh Newville represents six South Dakota couples, including the lesbian couple in Rapid City whose recent marriage in Minnesota triggered this suit.
Newville says the thrust of the suit is that South Dakota has targeted gays and lesbians by refusing to marry them and by refusing to recognize such marriages performed in other states.
South Dakota voters approved the constitutional ban against same-sex marriage in 2006. South Dakota Attorney General Marty Jackley has vowed to defend the ban, saying the issue should be decided by the voters, not by the courts.
