Jonathan Gurath sexual assault conviction upheld by appeals court

FOND DU LAC, WI (WTAQ) - The conviction of a Fond du Lac County man for sexually assaulting a 13-year-old girl has been upheld by a state appeals court.

Jonathan Gurath was convicted of multiple counts and sentenced to over 32 years in prison. Gurath appealed his 25-year sentence on the sexual assault count.

A circuit court rejected the motion and on Wednesday, the appeals court agreed.

“Here, Gurath’s challenge to the circuit court’s sentencing discretion is nothing more than a warmed-over version of his earlier sufficiency of the evidence argument. That is not a valid reason to overturn a presumptively valid sentence. In any event, we are satisfied that the court’s decision had a “rational and explainable basis” and considered appropriate sentencing factors,” the court wrote.
