FOND DU LAC, WI (WTAQ) - Civil lawsuits have been filed by two women jailed in conjunction with the disappearance of a Fond du Lac man.
Timothy Nance has not been seen since November 1. Investigators believe Nance is dead, but they have yet to find the body.
Last week, police arrested his wife, Eve Nance, along with Tina Ewell. Both were booked into the county jail on charges of hiding a corpse. However, no criminal charges have been filed yet.On Tuesday, the two women filed lawsuits against Fond du Lac County District Attorney Eric Toney and Sheriff Mylan Fink. They seek to be shown, "cause why the petitioner ought not be released from custody."
Prosecutors filed what's called a "Riverside" affidavit in order to keep them held in jail. But the suit claims that document is sealed and therefore the women cannot evaluate or challenge it. The writ argues the six days they have been held without a hearing before a judge is a violation of their Constitutional rights.
A hearing on the filings is scheduled for 11 a.m. Wednesday.
