APPLETON, WI (WTAQ) - A 41-year-old Hortonville man plead no contest to charges of repeatedly sexually assaulting a girl since she was six or seven years old.

In Outagamie County Court Wednesday, the attorney for Price Turner the 3rd tried to get a secretly recorded conservation thrown out.

The attorney argued that the victim, who is 15-year-old, could not consent to the recording which is required under Wisconsin law.  At least one of the parties must consent to being recorded.

The judge disagreed.

Turner’s lawyer says the no contest plea allows them to challenge the legality of the recording during appeal.
