MADISON, WI (WTAQ) - John Nygren has filed a complaint against the Government Accountability Board, asking he be placed back on the ballot for the 30th State Senate District recall race. 

This comes just a day after the GAB denied the Marinette Republican access in the recall election against Democrat Dave Hansen. 

Nygren handed into the Government Accountability Board 424 nomination signatures, and the board only validated 398, which is two shy away from him getting on the ballot.

Most of them were tossed because the person signing the petition did not live in the district.

In his petition, Nygren argues, among other factors, he was not given enough time to collect signatures or respond to the challenges.

Nygren's attorneys point out exmaples of two signitures that were tossed out and should not have been.  One assumes the presumption of unclear handwritting of an address, and the other person placed their work address which is outside the district but the person acutally live within the district.  Both challenges were made by a private voter, and Nygren's response to the challenges made no mention of either of supplied evidence against the challenge during the board meeting on Monday. 

Online court records show a Dane County Circuit Court judge is set to hear the case Friday morning.

Recall Hansen group organizer David Vander Leest right now is set to take on Hansen in the general election scheduled for July 19th.

If Nygren is reinstated to the ballot, the July 19 election would become the Republican primary and the general election would be held Aug. 16.
