CALUMET COUNTY, Wis. (WTAQ) - An Appleton area man who’s accused of killing his mother wants a judge to determine his fate instead of a jury. 40-year-old Brian Eklund has pleaded not guilty by insanity to a homicide charge in the death of 56-year-old Cynthia Bache in Calumet County in November of 2008.
Circuit Judge Donald Poppy has twice found Eklund mentally incompetent to stand trial – but experts said he regained his competency each time. Eklund reportedly told police he killed his mother because she made him go to church, take medications, and get mental health treatment.
But investigators and his attorney both say he’s delusional. A trial is set for July 13th and 14th – and if he’s found guilty, prosecutors say they will probably not challenge the claim that Eklund was insane at the time. That means he would go to a mental institution instead of prison.
