Specifically, in Lodi. The Mayor there wants to prohibit alcohol and tobacco ads within 500 feet of schools, playgrounds and other areas where children might see the messages. As the Wisconsin Reporter piece points out this has been tried before and failed in court.
Clearly this is a violation of first Amendment rights. And people such as Mayor Paul Fisk apparently have no idea the door they are opening when they choose to trample on first Amendment rights for what they consider the common good. Tobacco and alcohol, to the disdain of many, are still legal products. As such, they can be advertised (I still believe the TV ban on tobacco ads is unconstitutional).
I guarantee this will lose in court.
